Official Rules and Regulations

  1. PARTICIPATION CONSTITUTES ACCEPTANCE OF RULES. Participation in this Sweepstakes constitutes entrant’s full and unconditional acceptance of these Official Rules. Sweepstakes is sponsored by Valvoline, a division of Ashland Inc., Lexington, KY 40509 (“Sponsor”). Sponsor reserves the right to cancel the Sweepstakes at any time and substitute another promotion in its place. Sponsor is not responsible for printing errors in these Official Rules.

  2. NO PURCHASE REQUIRED TO ENTER OR TO WIN A PRIZE. Entrants do not have to purchase any products to win. A purchase does not improve chances of winning. Void where prohibited, taxed or otherwise restricted by law. Subject to all federal, state and local laws.

  3. ELIGIBILITY: This Sweepstakes is open to all legal residents of the United States and District of Columbia who are between the ages of 16 and 25 years of age as of May 7, 2008 and who are planning to pursue an education in the automotive field at an accredited Technical Institute or Vocational School. Eligibility is not based on GPA or financial need. Employees (their family members, and members of their household) of Sponsor, its parent, subsidiary and affiliated companies, advertising and promotion agencies are not eligible to win.

  4. HOW TO ENTER: Sweepstakes begins on May 7, 2008 at 12:01 a.m. EST and ends on December 1, 2008 at 11:59 p.m. EST (the “Promotional Period”). All entries become the property of Sponsor and will not be acknowledged or returned. Sponsor is not responsible for lost, late, misdirected, mutilated, incomplete, illegible, postage-due mail or stolen entries.

    Enter by mailing in your name, date of birth, address, email address (if available), phone number(s) and Technical Institute or Vocational School of your choice, including name of program, to Valvoline Scholarship Sweepstakes, P.O. Box 3080, St Cloud, MN 56397-3080, mail in entries must be postmarked by December 1, 2008 to be eligible; OR visit the web-site www.valvoline.com and follow the instructions during the Promotional Period. To be eligible you must submit all required information. Sponsor is not responsible for any technological problems that interfere with your attempt to enter. All Internet access and usage charges are the responsibility of the entrant. Limit of one entry per person regardless of method of entry, throughout the Promotional Period. Limit of one prize per person will be allowed. If for any reason the Internet portion of the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion, to terminate, modify or suspend the Sweepstakes. If Sponsor does not cancel the Sweepstakes, all entries received on-line before the on-line portion becomes inoperable, will be included in the random drawing. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Sweepstakes. Entries generated by robots or scripts are considered to be a direct violation of sweepstakes policy and will result in immediate disqualification of any and all associated entries. In the event of a dispute, eligible electronic entries will be considered made by authorized account owner of the email address submitted at the time of entry.

  5. PRIZES:
    GRAND PRIZE: One (1) entrant will be randomly selected to receive a $10,000 scholarship towards attendance in an automotive education program at an accredited Technical Institute or Vocational School approved by Sponsor. The approximate retail value of Grand Prize is $10,000.

    FIRST PLACE PRIZES: Five (5) entrants will be randomly selected to receive a $1,000 scholarship towards attendance in an automotive education program at an accredited Technical Institute or Vocational School approved by Sponsor. The approximate retail value of all First Place Prizes is $5,000.

    The approximate retail value of all prizes is $15,000.

    Scholarships will be sent directly to the winner’s school of choice, to be credited to the student’s account. Sponsor in their sole discretion reserves the right to approve the Technical Institute or Vocational School and program selected by the Grand Prize and First Place Prize winners prior to payment being made on winner’s behalf.

  6. WINNER SELECTION: First prize winners (5) total, will be chosen from all entries received from both methods of entry in a random drawing on the following dates: 1) July 15, 2) August 15, 3) September 15, 4) October 15 and 5) November 15, 2008. The Grand Prize winner will be chosen on or about December 15, 2008, from all remaining non-winning entries. All entrants who do not win a monthly prize will remain eligible to win a prize throughout the promotion. All entrants who do not win a monthly prize are eligible to win the GRAND PRIZE. Sponsor will attempt to notify potential prize winner(s) by phone, mail, e-mail or other delivery method. If the potential winner(s) fail to submit the affidavit in the time allowed, declines to accept the prize or a prize notification is returned as undeliverable, the potential winner(s) will be disqualified and the Sponsor will select an alternate winner(s). All winners are required to sign a Release and Affidavit of Eligibility, Liability and Publicity Release (where lawful) within fourteen (14) business days of written prize notification. Failure to comply may result in forfeiture of prize and an alternate winner will be selected. If the winner(s) is not of legal age in his/her State, those winner(s) must have a parent or legal guardian sign the Release and Affidavit. Except where prohibited, acceptance of prize constitutes permission to use winners’ names, likenesses and/or biographical information for promotion and advertising purposes, without additional notice or compensation. By participating, entrants release Sponsor its parent, subsidiaries, affiliated businesses, their advertising and promotion agencies and the officers, directors, employees and agents of each from any and all liability, damages or causes of action (however named or described) for injuries, damages or losses to persons and property which may be sustained in connection with this Sweepstakes or receipt, enjoyment, ownership or use of any prize. All taxes, including federal, state and local taxes are the sole responsibility of winners who may be issued an IRS 1099 tax form.

  7. ODDS: The odds of winning will be determined by the number of entries received from both methods of entry on or about the days indicated above. To obtain a winner’s list (available after January 15, 2009), send a self-addressed, stamped business size (#10) envelope to: Valvoline Scholarship Sweepstakes Winners, P.O. Box 3080, St. Cloud, MN 56397-3080. (residents of VT omit return postage). All requests for a Winner’s List must be received by March 1, 2009.

  8. DISPUTES: Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Kentucky; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Kentucky, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Kentucky or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Kentucky.
